Hot tub rules in Chatham
Every municipality sets its own rules for hot tubs. This is what the Municipality of Chatham-Kent publishes:
- Chatham-Kent’s Swimming Pool Enclosure By-law 125-2008 does not apply to a hot tub that can be secured by a cover with a locking device, as long as the cover is closed and locked whenever the hot tub is not in use.
- The by-law defines a hot tub as holding water more than 60 centimetres (24 inches) deep and being equipped with a lockable cover.
- The Municipality’s permit is for a pool enclosure, not for the pool or tub itself.
- For a hot tub without a lockable cover, ask Building Services at 519-352-8401 ext. 3215.

The cover that comes with an Arctic Spa is rigid, locks, and meets ASTM Standard F1346-91 — the safety-cover standard several Ontario municipalities name. Ask your showroom for the cover’s specifications if your municipality wants them with a permit application.
Separately, anywhere in Ontario: electrical work you hire out must be done by a Licensed Electrical Contractor, who files the notification of work with the Electrical Safety Authority. Every spa needs a GFCI breaker. See our site preparation guide for the electrical supply each spa needs.

Common questions
Do I need a permit for a hot tub in Chatham?
A hot tub with a locking cover falls outside Chatham-Kent’s pool enclosure by-law, provided the cover is closed and locked whenever the tub is not in use. The Municipality’s permit is for a pool enclosure, not the tub. Rules change, so confirm with the Municipality of Chatham-Kent before you install.
